By accessing or using the Website, you agree to be bound by these Terms and our Privacy Policy, incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Website.

• "Products": Refers generally to salon, barber, and spa supplies, cosmetics, tools, and accessories offered for sale.

• "Retail Customer": A Customer purchasing Products or Equipment for personal use or in non-bulk quantities.

• "Wholesale Customer": A Customer, typically a business or reseller, that has registered for a wholesale account and purchases Products or Equipment in bulk or at wholesale pricing for resale or professional business operation.

2. Eligibility and Account Registration

      2.1 General Eligibility

            The Website is offered and available to users who are 18 years of age or older and possess the legal capacity to form a binding contract. By using this Website, you represent and warrant that you meet all of the foregoing eligibility requirements.

      2.2 Account Creation

         You may be required to register an account to access certain features, especially for wholesale pricing and ordering. You agree to: a. Provide true, accurate, current, and complete information during registration. b. Maintain the security of your password and identification. c. Promptly update your registration data to keep it accurate and complete. d. Accept all risks of unauthorized access to your account data.

3. Products, Pricing, and Orders

     3.1 Product Information and Accuracy

         Cosmo Line endeavors to be as accurate as possible with Product descriptions, images, and pricing. However, we do not warrant that Product descriptions, colors, or other content of this Website are accurate, complete, reliable, current, or error-free. The actual color of Products may vary due to photographic lighting sources or monitor settings.

      3.2 Pricing

          a. Retail Pricing: Prices for Products sold to Retail Customers are clearly displayed and subject to change without notice. Applicable taxes and shipping fees will be calculated at checkout.

        b. Wholesale Pricing: Wholesale Customers will see specific discounted pricing upon logging into their approved accounts. Wholesale pricing is confidential and must not be shared publicly.

     3.3 Order Acceptance

         Your receipt of an electronic or other form of order confirmation does not signify our final acceptance of your order, nor does it constitute confirmation of our offer to sell. Cosmo Line reserves the right at any time after receipt of your order to accept or decline your order for any reason, or to supply less than the quantity you ordered.

4. Payment Terms

    4.1 General Payment

         We accept various payment methods as indicated on the Website. You represent and warrant that:

                (i) the payment information you supply is true, correct, and complete;

               (ii) charges incurred by you will be honored by your payment card company or financial institution; and

               (iii) you will pay the charges incurred by you at the posted prices, including all applicable taxes and shipping fees.

 

    4.2 Wholesale Payment Terms

      Wholesale Customers may be offered specific payment terms (Net 30 days) subject to credit approval. If such terms are granted, payment must be received by the due date. Failure to meet payment deadlines may result in the suspension of wholesale privileges, a reduction of credit limits, and/or late payment fees.

5. Shipping, Delivery, and Risk of Loss

​

     5.1 Shipping and Delivery

       We will arrange for shipment of the Products and Equipment to you. Delivery dates provided are estimates only and are not guaranteed. We are not liable for any delays in shipments.

     5.2 Risk of Loss

      Risk of loss and title for items purchased from Cosmo Line pass to you upon our delivery to the carrier. This means that you are responsible for filing any claims with the carrier for damaged and/or lost shipments.

    5.3 Inspection and Claims (Crucial for Wholesale)

​

     a. Immediate Inspection: The Customer (especially Wholesale Customers) must immediately inspect all Products and Equipment upon receipt.

        b. Damage or Discrepancies: Any claims for shortage, defect, or damage must be reported to Cosmo Line within the same day of delivery. Failure to report within this timeframe constitutes acceptance of the Products/Equipment as delivered and waives all future claims.

 

6. Returns, Refunds, and Exchanges

     6.1 Retail Returns Policy

     Retail Customers may return unused, unopened Products in their original packaging within seven ( 7 ) days of receipt for a refund or exchange, subject to a restocking fee (if applicable) and excluding original shipping charges. Items marked as "Final Sale" or "Non-Returnable" cannot be returned.

    6.2 Wholesale Returns Policy

​     Wholesale Orders: Due to the nature of bulk ordering, all sales to Wholesale Customers are generally considered FINAL. Returns are only accepted for manufacturing defects reported within the inspection period (Section 5.3) and will be handled via replacement, repair, or store credit, at Cosmo Line’s sole discretion.

   6.3 Health and Hygiene Items

   For health and hygiene reasons, certain items (e.g., opened cosmetics, implements, personalized tools) are strictly non-returnable and non-refundable once the sealed packaging has been opened.

7. Intellectual Property

​

     The Website and its entire contents, features, and functionality (including all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by Cosmo Line, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website, except as generally permitted for the purpose of placing an order or using the services.

 

8. Disclaimer of Warranties and Limitation of Liability

 

    8.1 Product Use

     Cosmo Line sells professional supplies and equipment. The Customer acknowledges that they are responsible for ensuring that all Products and Equipment are used by trained, licensed professionals, in accordance with all manufacturer guidelines, safety warnings, and applicable local laws. Cosmo Line is not responsible for any injury or damage resulting from the improper use, installation, or application of our Products or Equipment.

   8.2 Limited Warranty on Equipment

  Equipment may be covered by the original manufacturer's warranty. Cosmo Line makes no warranties beyond those provided by the manufacturer. Warranty claims must be processed through the original manufacturer, though Cosmo Line will assist where reasonably possible.

 

   8.3 Limitation of Liability

   To the fullest extent permitted by applicable law, in no event will Cosmo Line, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from

     (i) your access to or use of or inability to access or use the Website;

     (ii) any conduct or content of any third party on the Website; or

     (iii) unauthorized access, use, or alteration of your transmissions or content.

9. Governing Law and Jurisdiction

     

       These Terms and Conditions and any dispute or claim arising out of or related to them, their subject matter, or their formation (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the internal laws of United Arab Emirates without giving effect to any choice or conflict of law provision or rule.

      Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Website shall be instituted exclusively in the courts located in Dubai, U.A.E.

10. Termination

    We may terminate or suspend your account and bar access to the Website immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. This includes, but is not limited to, fraudulent activity, non-payment, or unauthorized sharing of wholesale pricing.

11. Miscellaneous

    11.1 Severability

      If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

11.2 Entire Agreement

    The Terms and our Privacy Policy constitute the sole and entire agreement between you and Cosmo Line Cosmetics Trading regarding the Website and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.
